By accessing or using Plex Scale services, you agree to comply with the following Terms of Service.

Overview

Welcome to Plex Scale. These Terms of Service ("Terms") govern your access to and use of our hosting infrastructure, network, and related services.

These terms exist to ensure a fair, stable, and secure hosting environment for all our clients. By utilizing our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Eligibility

To use our services, you must be of legal age in your country of residence (typically 18 years or older) to form a binding contract. If you are under the legal age, you must have explicit permission and direct supervision from a parent or legal guardian who accepts these Terms on your behalf.

By registering an account, you represent and warrant that you meet these eligibility requirements.

Services

Plex Scale provides high-performance cloud hosting, bare metal servers, and specialized application hosting. Our services are provided "as available."

Specific features, resource limits, and hardware specifications may vary depending on the plan you select during checkout. We reserve the right to modify, upgrade, or alter the underlying hardware or software stack to maintain network security and overall performance.

Payments & Billing

All services are billed on a prepaid basis. Provisioning of your selected services begins only after successful payment confirmation.

You agree to keep your billing information current. Recurring payments must be successfully processed prior to your billing cycle renewal date to ensure continued, uninterrupted service. Failure to pay invoice balances will result in automated suspension and eventual termination of services.

Manual / Partial Payment Rule

If you choose to pay an invoice manually or submit a partial payment towards a balance, the remaining total amount must still be paid in full by the due date.

Important Payment Notice

Partial payments do not extend service dates. Services may remain limited, suspended, or unprovisioned until the full invoice amount is received and cleared.

Abuse & Prohibited Use

Our infrastructure must not be used to engage in illegal, malicious, or highly disruptive activities. Prohibited uses include, but are not limited to:

  • Hosting or distributing malware, viruses, or destructive code.
  • Running phishing sites or engaging in identity theft.
  • Initiating or participating in DDoS (Distributed Denial of Service) attacks.
  • Attempting unauthorized access to other networks or systems (port scanning, brute forcing).
  • Hosting illegal content or materials that violate intellectual property laws.
  • Child exploitation materials (results in immediate reporting to law enforcement).

Any violation of this section is grounds for immediate, unrefunded termination.

Resource Usage

Unless explicitly stated as "Dedicated," our services operate in a shared resource environment. Fair-use expectations apply to ensure optimal performance for all clients.

  • CPU Abuse: Sustained 100% CPU usage on shared cores that degrades host node performance is prohibited.
  • Network Abuse: Consistently maxing out uplink ports to the detriment of network peers is not allowed.
  • Disk I/O: Excessive read/write operations that stress storage arrays may be throttled.

Data & Backups

While we implement robust redundancy across our network (such as RAID NVMe arrays), you are ultimately responsible for your own data safety and backups.

Plex Scale does not guarantee data retention in the event of catastrophic hardware failure, client misconfiguration, or account termination. We strongly advise maintaining off-site backups for all critical data.

Suspension Rights

Plex Scale reserves the right to suspend or limit access to services immediately, with or without prior notice, under the following conditions:

  • Failure to pay outstanding invoices.
  • Detection of network abuse, malware, or outgoing DDoS attacks.
  • Your service becomes the target of a massive inbound DDoS attack that threatens core infrastructure.
  • Any direct violation of our Acceptable Use Policy or these Terms.

IP & Network Changes

Plex Scale retains ownership of all IP addresses assigned to your services. We reserve the right to change IPs or alter network routes due to infrastructure upgrades, datacenter migrations, or upstream provider changes.

While we strive to provide advance notice for any IP changes, emergency routing adjustments may occur immediately to preserve network stability.

Limitation of Liability

To the maximum extent permitted by law, Plex Scale shall not be liable for any direct, indirect, incidental, or consequential damages resulting from:

  • The use or inability to use our services.
  • Data loss, corruption, or unauthorized access to your servers.
  • Downtime, network outages, or hardware failures.
  • Actions taken by third parties or malicious actors.

Our total liability for any claim arising out of these Terms shall not exceed the amount you paid for the service during the month the incident occurred.

Account Conduct

You must provide accurate, current, and complete information during registration. Using fake details, temporary emails, or hiding your identity via VPNs during checkout may flag your account for fraud prevention.

Account sharing or reselling services without explicit authorization from our Enterprise team is prohibited. Furthermore, any verbal or written abuse toward our support staff will result in immediate suspension.

Service Termination

You may cancel your services at any time via the client dashboard. Cancellation requests must be submitted before the next billing cycle to avoid charges.

Severe Violations

Plex Scale reserves the right to terminate any service immediately, without refund or prior notice, in cases of severe policy violations, fraud, or illegal activity.
